The Judge’s ruling on our Summary Judgement was NOT in our favor; however we want to bring out some very positive aspects.
1. The Judge found that CANSS & RG*NEW along with the Citizens had standing to bring this case and hold the PUD accountable.
2. The Judge found that the PUD failed to follow the statutes in conducting the sale.
3. While we believe the Judge was mistaken in allowing the public land sale to stand, we are carefully reviewing the decision with our attorneys and expect an appeal to be filed. Whatever the Judge’s decision, an appeal was likely inevitable by somebody.
4. This was only one small piece of the puzzle. The smelter needs to clear many more legal and procedural hurdles before it could ever precede, including the County zoning process and the inevitable court appeals on all fronts.
5. We are dedicated to the goal of stopping the smelter from destroying everything we love and cherish and will keep up the fight!
